Not so in Scotland. Marriage by cohabitation and repute still exists, and will continue to do so for preโ€“2006 commencing cohabitations until all those relationships, and the estates of the parties to them, cease to exist. Section 3(2) of the Family Law (Scotland) Act 2006 is the relevant law.
